Scientology's Crushing Defeat

A previously unpublished saga of an $8 million check

Six years ago, when I was a reporter atNew Times LA, I’d written several stories about Scientology (Los Angeles is one of its headquarters), and I was about to uncork the longest one yet—a 7,000 word piece about an embarrassing, $8 million defeat Scientology had just suffered, when the weekly paper suddenly folded. That unpublished story has been sitting in storage ever since. Fast forward to 2008, and the world of reporting on Scientology has changed radically, thanks in part to the lunacy of Tom Cruise, but also in part to a worldwide, leaderless movement that calls itself Anonymous. Ravenous for any information about L. Ron Hubbard’s strange organization, Anonymous scours the world for the least tidbit about Scientology. Well, here was a pretty meaty morsel just sitting in my hard drive. It’s still a substantial bit of reporting, and it fills in some gaps in the historical record of one of the most humiliating court losses Scientology has ever suffered. Originally scheduled to be printed in October 2002, the piece follows. (It’s unchanged except for updates in[brackets].) This material may come as a revelation to some readers, but even for the know-it-alls at Anonymous, there are juicy bites.—Tony Ortega

What Scientology Paid $8 Million To Hide

With an hour to spare, Hubbard’s minions settle a debt they vowed never to pay

Even before it started, the 1986 trial of Lawrence Wollersheim v. the Church of Scientology of California caused a mob scene at L.A.’s downtown superior court.

When a judge decided during pretrial motions that documents describing confidential Scientology beliefs should be put in a file open to the public, 1,500 Scientologists swamped the court clerk’s office to keep anyone else from requesting them. The next day, the judge resealed those records. But an L.A. Times reporter managed to get past the crush of Scientologists and copy the file. Newspapers around the country had a field day with what the Times reported: the documents showed that high-level Scientologists are taught that each human contains the souls of alien creatures banished to Earth 75 million years ago by a galactic overlord named Xenu.


Scientology’s process of “dianetics,” developed by science fiction writer L. Ron Hubbard over a period beginning in the late 1940s, was supposed to rid the body of those alien creatures. But Lawrence Wollersheim, who had defected from Scientology after serving 11 years and making about $50,000 in payments, claimed that the organization’s pricey rituals instead had made him insane and drove him to the brink of suicide. He filed suit in 1980, and six years later his trial was a sensation. Still the most expensive civil trial in L.A. court history, [This was true even in 2002, post-Simpson—T.O.] it made headlines almost daily in the spring and summer of 1986 as Scientologists jammed the courtroom and protested outside of it, complaining that their religious freedoms were being trampled on. For many in the public, reports of the trial gave them their first detailed description of Scientology, which today counts such celebrities as John Travolta and Tom Cruise among its members. Travolta himself made a visit to the trial that May which was widely reported.

In the lawsuit, Wollersheim claimed that after he left Scientology in 1979 the organization retaliated by destroying his business and attempting to destroy him. In five months of testimony, Wollersheim, his psychologist, and former Scientologists described the coercion he was subjected to, sacrifices he was expected to make, and bizarre teachings he was fed, which made Hubbard’s outfit sound more like a mind control cabal out of The Manchurian Candidate than the mainstream faith it claimed to be. Scientology’s attorneys countered that Wollersheim had come to the organization with a preexisting mental condition and was a drug user. Wollersheim was seeking $25 million in damages.

The jury awarded him $30 million.

It was a stunning blow to Scientology, but probably the most lasting impression that many took from the trial was the reaction of Scientologists themselves, who continued to protest at the courthouse day after day for more than a month after the verdict. Staging their demonstrations from a tent city set up across the street, the members wore pins made from ten cent coins and chanted over and over: “Not one thin dime for Wollersheim!”

It was a vow that Scientology kept for 16 years.

In 1989, an appellate court upheld the verdict but reduced Wollersheim’s award to $2.5 million. But even before the original trial started, and for years afterward, various Scientology entities hit Wollersheim with other lawsuits, exhausted every possible appeal, filed mountainous legal briefs, claimed that the particular entity he had sued was broke and could never pay him, and found other ways to put off paying the money.

Even after the case had twice been to the U.S. Supreme Court and the last possible appeal had been denied, Scientology seemed determined that it would never go back on its promise to deny Wollersheim even one thin dime.

And then, suddenly, Scientology threw in the towel.


On May 9 [2002], the Church of Scientology of California, an entity which had once been considered the “mother church” but for a decade was supposed to have been dormant and broke, submitted a check to the superior court for $8,674,843 to cover the $2.5 million judgment and the interest it had accrued.

    the Mormon tithe comes from the Bible. it is 10% if you can afford it. you dont have to pay tithing to attend church, they will even help you out with food. They have stores called Bishops Square where poor mormons can go get grocercies and get help paying other bills like rent and util. . All of the money the LDS church takes in goes to building churches, temples, and missionary and charity work. You cant really compair the two, Scientology and Mormonism

    Pfft! What a silly contention there godfree. Maybe if you knew the actuial history and faqcts about the cult of scientology(globally), you'd not make such a silly comparison. You need to read a good book. Try reading L Ron Hubbard's 'Science of Survival' and get a glimpse of the genocide that would ultimately be perpetrated should scientology EVER sieze power.     Regarding removal of tax exempt status for Scientology, why stop there Examine the vast wealth of the Mormons in Utah & Idaho. Then what still remains of the wealth of the Roman church after paying off all those victims. Currently, religions collectively own over 25 % of all the privately owned land in America. Tax free. This outrage cries out for reform.

    It still makes me SICK that they were "rewarded" for their often illegal activities with tax-exempt status! There is NO question but that this is a "for profit" scam and NOT a "religion" in the legal sense of the term. I would HOPE that eventually we will have a commissioner that is willing to take this on and restore our confidence in the legal system because right now it is apparent that if you have enough money and a willingness to resort to criminal acts, you can beat the system down! This is WRONG!

    I think this is the best article you've ever written about Scientology Tony! I've read and re-read your Scientology articles, and in this above article, there are still some loose ends which I hope someday we can find MORE information about. Particularly Joe Yanny, the one time Scientology attorney said other Scientology attorneys did some illegal and underhanded stuff. We now have Marty Rathbun to confirm or give further details. Marty was in the same room and heard a LOT more directly in private from David Miscavige, and Marty knows about all that dirty stuff that absolutely WOULD have tanked Scientology's tax exempt status. Ask Marty about Joe Yanny's charges. Someone needs to hold Marty's feet to the fire on what Marty did in Marty's days during the 1980s and particularly as relates to the dirty tactics done against Larry Wollersheim especially all the legal crap of the late 1990s, which rightfully Scientology lost. This article is in my opinion one of the most important articles which has even today some great unresolved past misdeeds sitting there, ready to be further investigated, and Marty Rathbun I hope is up to talking about those details.

    The money that is attained from member's tithes is well documented and used for the construction of buildings, funding of church universities and helping people throughout the world. No leader of the "mormon" church is profiting from tithing or fast offerings. The Church is actually quite open about where its funds come from and where they go.

    You'd actually be pretty bored to see the "inner workings" of Mormonism. Most of the wealth of the church consists of farms and facilities that produce the food and clothing that goes into their welfare program. The clergy are unpaid, and the "fat cats" at the highest level of leadership receive a modest stipend for their living expenses, for which they devote most of their waking hours. That's about it. The president of the church was recently given a private jet, and from the looks of it he uses that to further pack his schedule with visits to religious services in various parts of the world. A Mormon president works until he dies of exhaustion and another one steps up to take his place.

    Deborah's comment is pretty standard Scientology practice - if somebody's a threat to the organization, slander them, sue them, attack them in the press, whatever it takes to discredit them and discourage anybody else who might do the same thing.

    It would be nice to learn of the Mormon's inner workings. The Mormons expect each member to tithe, which is certainly a lot more than Scientology has extracted from their members. When will; America wake up & demand accountability - & taxes from these businesses ?

    This is very interesting that Dan Leipold sued Scientology. I sued Dan Leipold in 2007 and he died 2 weeks after learning I'd retained the malpractice attorney, Eugen Andres, of Andres & Andres, to sue him. Leipold neglected to properly file and advise me regarding a wrongful death, elder abuse case against a nursing home chain, Sun Healthcare Group, who was responsible for harming my mother and her subsequent death. Leipold had my documents which proved it. Gee, think he was a little stressed out? One year earlier I'd gone into surgery for a tumor on my pancreas and survived by just a few weeks. Certainly Leipold thought I'd die and my brother knew nothing about our case because he'd rarely visited our mom in that nursing home. Leipold probably sold us out to Sun because we could also prove willful misconduct by two board members of Sun Healthcare and they could have lost their jobs for good cause. Even the Dept of Health turned a blind eye and didn't fine them the usual $100,000 for a death for any of the five deaths I knew about in my limited amount of time spent in the facility. There is a huge corporate and political corruption that the Board of Directors of Sun Healthcare has only recently been informed about. Stay tuned this will be in the news.

    The reporter had great courage in assembling the story together. This material is so explosive, I can see why the original weekly newspaper that was supposed to run this article, folded. My opinion is that this was too much of a coincidence. Larry Wollersheim also had great courage coming forward with his story about the Church of Scientology. This is nothing but a cult, not a true religion, based on what this article says. Dear God in Heaven! I know of no religion -- Christianity, Judaism, Islam, Shinto, Buddhism, Taoism, Hinduism, whatever -- that operates the way the Church of Scientology does. May God Almighty preserve humanity from the dangerous cult that is the Church of Scientology.

The Cult�s method of healing called �Touch Assist� is nothing more than erasing the physiological reactions of PAIN. Physiological reactions are the clues from the law of God called �The Law of Cause and Effect�; for every action there is a reaction. A complete understand of these two laws of God can be used to learn to self-heal. To understand the sinful secrets of your enemy �is to know exactly where to hurt him. To tell your mother that you invented a new religion, because you discovered why you farted, is a good example of the scam that Ron pulled on you. He got away with it because the world did not see these reactions as they applied to reading. Or if some scientist saw and knew it�he did not protest it and allowed a Cult to claim it as their own new discovery. If you want to destroy the cult, study your own reactions each time you do something�learn to read yourself and use your own power of obnosis to discover the real world within and around you.     I disagree with everyone of you. A church does not commit crimes, people commit crimes. When Al-Qaida members commit violent acts of terrorism, we don't blame Islam When crazy christians bomb abortion clincs, we don't blame the entire faith of christiniaty. When mormons engage in polygamy and statory rape, we don't blame the entire mormon religion as a whole. But anytime a scientologist engages in wrongdoing, we immediately impute the entire thing on the church of scientology. I, for one, am sick of living in a society where we blame other people for the individual actions of other people. If a scientologist gets drunk tonight and beats his wife, then that guy committed the crime. Not John Travolta, not Tom Cruise, not the entire church of scientology. Secondly, using the word "cult" is an offense term that has no real meaning. Do you think scientologist's consider themselves a "cult" ... of course not. Only people who do not like scientology use that word. It's the functional equivalent of using the N-word. Neither one has any real binding criteria they are used to take away the legitimacy of a minority group. Christianity was seen as a cult for hundreds of years before enough people bought it. To put it simple, the only difference between a "Cult" and a "Religion" is the size of the congregation. Furthermore, I admit it: scientology is stupid. But is it really any stupider than religions about talking snakes? Is it really any dumber than one where Jesus and Native Americans hung out together in the 1800s? How about religions that believe you go to a planet full of virgins when you die? No, it's not. Xenu only sounds dumb because so few people buy into that crap. But if enough people did buy into Xenu, it would be no different than talking snakes. Also, it is ridiculous that you have to pay to advance in scientology. But you know what, this is the choice of a scientologist. But churches don't run for free. Mainstream religions have big congregations and don't need forced donations...they just pass around a hate and let peer pressure take over. But smaller groups require mandatory funding. If a scientologists wants to "donate" money, then it's his business and none of ours. Unless a scientologist gets in your face about his religion, just let them do their own thing and worry about your own life.

    There were not hundreds of comments, but about a dozen, that were temporarily lost when we relaunched the website several weeks ago. We tracked them down, and put them back up (notice, for example, the comment from Wollersheim himself, which was one of the temporarily missing). Calm yourself.     Please!! Tell us what happened to all of the comments that were here before. It is very frightening to think that the organisation got to you, but what other conclusion can we draw from the fact that all (hundreds) of the (mostly derogatory) comments that were here before are gone. After reading the story, the facts of which were chilling enough to cause nightmares for many of us, we come back to re-read the article and find all of the previous comments have been deleted. This alone is enough to heighten the paranoia which this story has induced. I am amazed to believe that the Voice, of all American media, could be bullied by these people. But, what are we to think. I imagine this will be the subject of many blogs now, if it isn't already. Since I just got back from holiday, I haven't been online for quite a while. I will be looking to the blogging community for answers, or at least clues, to this (honestly) burning question. To all people who don't believe in the anti-Christ, I think after this you might reconsider. I think 'he' could very well be a member of the Scientologists. Please, Village Voice, show us the integrity for which you are so well-known, and let us know what has happened here. This is the stuff of which nightmares are made.

    Excellent expos�At the risk of sounding unsympathetic to people exposed to and manipulated by the insane tactics of Scientology and other cults -- what IDIOT would hand over huge sums of money to anyone but his own family or friends in need? Jason Beghe is hardly an A-Class star (though I like his work very much). I'm sure he worked darn hard to make a million bucks. And he hands it over to Scientology? C'mon, a fool and his money are soon parted. While I am not, in any way, a fan of organized religion, at least I could (if I chose) pray to various gods, find solace in their belief system, without having to PAY. But perhaps the difference is: I don't believe there is inherently anything WRONG WITH ME that needs fixing.

    Scientology founder Hubbard tried to defend himself through his co-accused executives before french courts in a lengthy trial between 1971 and 1978: he lost and was convicted to 4 years unsuspended jail for fraud. Since, many other scientology people or organizations have gotten years of jail and big amends in France for homicides, fraud, extortion, tax problems and other law violations. Tony Ortega did a great job here.     The following was written by Lawrence Wollersheim the person mentioned in this article. Lawrence is the co-founder of FACTNet.org (the oldest and largest Internet non profit cult education and cult survivor support organization,) who after 20 years of legal battling won a lawsuit against the Church of Scientology where he not only collected 9.2 million dollars, but the lawsuit also paved a legal highway for others who also have suffered damage of all sorts at the hands of the Scientology along with those harmed by other destructive cults to receive both compensatory and punitive legal damages in lawsuits. To all survivors of cults (and their families friends, supporters and advocates,) particularly those from Scientology, I a strongly recommend that you or any cult survivor that you know read the following final court decision in full! It is the Wollersheim vs. Scientology Appellate decision that was affirmed all the way to the US Supreme court. It is now US legal precedent of the United States that can be used by all cult survivors, and even more so if you were involved in Scientology. This legal decision was so bad for Scientology --- and Scientology does so poorly in front of juries of normal people, that Scientology has not allowed another one of these cult survivor cases to go to trial since the Wollersheim decision disaster came out in the early 90�s. Unfortunately, these out of court settlements with Scientology�s abuse survivors only give the survivors about 10 % of what they would have actually received from a jury at trial. This low settlement payout is in part because Scientology tries to make the survivors suing them think that the Wollersheim case was somehow a victory for them by their won twisted and insane logic� If you know of someone who has been hurt by a cult, have him read court this full court precedent and then get this information to a good attorney in a good mid to large size law firm. (Small firms are eaten for lunch by the Scientology litigation machine.)The legal pathway of critical legal precedents has been broken wide open for others to use at great personal and team cost in the Wollersheim court victory. Never, never forget that Scientology loses horribly in front of juries. Normal people see right through them for ruthless and mean liars that they are. They creep juries out and it makes them want to legally punish Scientology for harming people so severely while calling themselves a religion/ Go to trial as fast as you can and get everything that you deserve and this will encourage others to do the same. I did and, in the end not only was our legal team able to put this tremendous and crushing legal precedent there for all cult survivors, Scientology also paid me a total of just over 92 million dimes (9.2 million dollars�) Only if you too use the courts to get all that you deserve for any cult abuses that you have suffered will there be any chance that Scientology will ever change their abusive and outrageous behaviors and others will be safe in the future! Only when we collectively fight back fairly in the courts and all take ALL of the profit making out of Scientology�s human rights abuses, unethical use of mind control, brainwashing and wrongdoing will it ever, ever end! I and my legal team did our job in the courts. It is now up to you and your advocate and legal teams to do the rest to take every ill-gotten, coerced and stolen dollar back and away from the monster that Scientology is and will continue to be unless all it�s harmed survivors sue them for restitution and justice!     What an epic battle! Larry Wollersheim has fought an heroic battle against the giant that is Scientology. His story is horrific, including being held captive aboard the Freewinds. Unfortunatly, his experience is not rare in Scientology. This is why we protest. God bless Larry, and Tony Ortega also, for not being "shuddered into silence". Will America's taxpayers demand that the IRS bring the law to bear on Scientology? Will you?

Now I see good reason to follow the Voice (which I used to read and even write for while in NYC) for the same reason. You've mooshed together the names of Samuel Rosen and Elliot Abelson--purposely? They are two of $cientology's most feared lawyers, the one because he's a former Mafia attorney with no conscience (Abelson), the other because he is a NYC litigation attorney who specializes in intimidation and provocation (Rosen).     Thank you Mr Ortega! Gone are the days when individuals who are deemed by the Scientology cult a trouble source may be eliminated "without sorrow" (as L. Ron Hubbard put it), without the public noticing. L. Ron Hubbard never anticipated the Internet, or its technocratic power. His cult does not know how to deal with Bad Stuff About Scientology on the Internet as a result, beyond the same old tired tactics Scientology has used forever: intimidation, PIs, attempted destruction of the 'trouble source', the list goes on. And it has been demonstrated for the public by Scientology itself as a result of these tactics being used in the Internet equivalent of full view. More all the time it is all too evident that Scientology hasn't just been caught out and protested against in recent times, but all the way back to its founding.
