Thief Faking Deaf and Mute for Three Years Now
Wendy Gabriel has been acting like he can't speak or hear since he was arrested in May 2008, successfully delaying his trial for three years by getting granted 64 adjournments. Gabriel only communicates with lawyers and judges through handwritten notes, but was denied a request to represent himself in court when a psychologist testified that he's full of shit. "There's no dysfunction," the expert said. "He's not speaking because he doesn't want to." The prosecutor says, "It has to stop," while the judge is favoring bribery on the self-representation front, telling Gabriel, "If you begin to speak, I will reconsider my decision." Gabriel stands charged with robbery, assault and grand larceny. And no, despite his behavior he is not, in fact, seven years old. [NYDN]
