Whisper's Lounge Faces Lawsuit for Fatal Shooting
Dwight Lewis, 27, was shot and killed inside Whisper's Lounge, a Bronx night spot, last year. Now, his estate seeks to hold the club's owners responsible for not preventing the homicide.
The venue "negligently provided security" and "failed to detect weapons carried by its customers prior to the customers being allowed to enter," states a complaint filed Thursday in Bronx Supreme Court.
According to the NYPD's account, Lewis got into an argument with another man at around 4:10 a.m. on July 7, 2012. The man had apparently been carrying a concealed gun. He drew the weapon and shot Lewis in the stomach before fleeing the scene.
Lewis died at Jacobi Hospital shortly after.
Police arrested Eugene Long from the crime in November 2012. Prosecutors have charged him with second degree murder, as well as one count of first degree manslaughter and a count of criminal possession of a weapon. Long pleaded not guilty and is awaiting trial.
Whisper's Lounge is inside Whisper's Inn, which also has a sports bar. The complaint, which was filed by Lewis's estate, claims that Whisper's should have kept tighter security at the lounge "based on the number of crimes that took place" there prior to Lewis' death.
Though the complaint does not cite specific incidents, there was at least one that happened in September 2010. After an argument inside the club at around 4:30 a.m., a group of four women began hitting another woman, according to police. That woman tried to get to her car and leave, but the group pulled her out. They stole $500 from her purse and fled.
