Another day, another lawsuit. This one comes courtesy of Stephanie Capsolas and Hernan Ricardo Alvarado, a server and runner, respectively, at Babbo. Grub Street reports that Maimon Kirschenbaum (who’s repped workers from Cafe Habana, Barolo, and Milos, to name but a few) has filed a class-action lawsuit against Mario Batali and Joe Bastianich alleging that Capsolas and Alvarado often worked without being paid minimum wage or overtime, and that tips were shared with non-tipped employees. Which seems to be an increasingly common complaint these days.
